Purpose and legal basis for using your information

When providing you with services under your Legal Protection cover, RAC Motoring Services and RAC Insurance Limited (‘RAC’) are the data controllers of your personal data. The RAC will use the information provided by you for the purpose of administering the services under your Legal Protection cover, including the establishment, exercise, or defence of a claim.

This privacy notice covers how RAC handles your personal information when you purchase Legal Protection cover.

For more information on the handling of your personal information relating to any other insurance products purchased in conjunction with this one through a third-party insurance, please refer to their own privacy notice.

When you use your Legal Protection cover, RAC will be a data controller for the following additional purposes:

Monitoring and recording: From time to time, we may need to review communication with you for quality and compliance reasons.

Legitimate interest

Your rights: Complying with your data protection requests under the UK Data Protection regulation and the General Data Protection Regulation.

Legal obligation

Regulatory obligations including fraud detection: We use your personal data to comply with our regulatory obligations including for the prevention, detection and reporting of fraud.

Legal obligation

For each different purpose for which we use your data, we need to have a lawful basis. The different lawful bases are set out in the UK Data Protection regulation and the General Data Protection Regulation. The ones we are relying on are:

  • Legitimate interest: We rely on this basis when our use of your data is necessary for the purposes of our legitimate interest which does not unduly impact your rights and freedoms.
  • Contract: We rely on this basis when our use of your data is necessary for the purpose of fulfilling our obligations under a contract which you have with us.
  • Legal obligations: We are required to comply with legal and regulatory obligations, such as the prevention, detection and reporting of fraud and other financial crime.

  • From you: We receive information from you when you contact us directly.
  • Third Parties: We receive information from your insurance provider, or nominated claims handlers when you purchase legal expenses cover.

How long we keep your information for

The RAC keeps your personal information for as long as the law requires, in line with applicable legislations.

Who we share your information with

We may share your information with third parties such as:

  • RAC group companies: For administration purposes and to help us understand your relationship with RAC.
  • IT providers: Providers of IT services for administration and management of our internal systems
  • Regulators: Regulators and governmental bodies, such as the Financial Conduct Authority or Information Commissioner’s Office if necessary to meet our mandatory reporting requirements.
  • Professional advisors and purchasers: Our professional advisors for the purpose of providing us with professional advice. If RAC is sold, we may need to disclose your personal information to our advisers and any prospective purchasers and their advisers.
  • Lawful firms: In the pursuit or defence of a legal claim, we may share your personal information with your chosen solicitors and the opposite party’s solicitors or insurers.
  • RAC business partners: To administer your claim, we may need to send information back to the third-party who you have your policy with.
  • Insurers: As part of an uninsured loss recovery claims we may need to disclose information to other insurers.

Where your information is held

The RAC is a UK-based business providing services across Europe. Your personal information is managed on our administration systems and databases.
If we need to transfer your personal information to a country outside of the UK or EEA, we will make sure appropriate safeguards are in place.
